Terms of Service

Last updated: 1 November 2026

These Terms explain how website optimisation and landing page services are requested, agreed, delivered, reviewed and paid for. I keep the process straightforward: the scope and price are agreed before work starts, you review the completed work, and payment is requested only after you approve the result.

1. Who provides the services?

The services are provided by Michal Kanclerz, an individual service provider based in Poland. I can be contacted at hi@michalkanclerz.com or through the WhatsApp contact link on michalkanclerz.com.

These Terms apply to individuals and businesses who enquire about or order services through the website or by email or WhatsApp.

2. Services covered

The services may include, depending on the individual offer:

  • Website optimisation: review and optimisation of an existing WordPress or WooCommerce website, which may include caching, image, video, font, HTML, CSS, JavaScript and CDN-related optimisation.
  • Landing page creation: design and development of a landing page for advertising or another agreed purpose, including agreed structure, content, responsive layout, calls to action and integrations.
  • Related work: other specific changes or tasks expressly agreed in writing before work begins.

The exact tasks, exclusions, target website, deliverables and any dependencies will be confirmed individually in writing. A feature is not included merely because it is mentioned as an example in these Terms or elsewhere on the website.

3. Enquiries, quotes and when a contract is formed

You can contact me by email or WhatsApp. An enquiry or discussion does not by itself create an obligation to purchase.

Before work starts, I will confirm the service, its scope, the price or pricing method, the expected delivery time and any important requirements in a written message. A contract is formed when you clearly accept that proposal in writing (for example, by email or WhatsApp) and I confirm that I accept the order.

Any work outside the agreed scope requires your approval first. Additional work may involve an additional fee and/or a revised delivery time. I will not knowingly add chargeable work without first agreeing it with you.

4. Prices and payment after approval

The price is agreed before work begins. Unless the written offer says otherwise, the website optimisation service advertised at €97 is a one-time fee. Landing page projects and any other individually scoped work are quoted separately. The agreed message will state the currency and whether any taxes or other charges apply.

You do not pay upfront. Once I have completed the agreed work, I will provide access to or a link to the result so you can review it. When you confirm that you approve the completed work, I will send you a payment link generated by Stripe.

The payment link must be paid within 24 hours after it is sent, unless a different deadline is expressly agreed in writing. The payment obligation remains due even if the payment link expires or needs to be reissued. If payment is not received by the deadline, I may send a reminder, suspend any further support or handover not yet provided, and pursue the outstanding amount through lawful means. Any statutory rights and mandatory consumer protections remain unaffected.

Payments are processed by Stripe. Card and payment details are handled by Stripe under its own terms and privacy information; I do not receive or store your full card details.

5. Delivery time and client cooperation

Where the offer states 24-hour delivery, that period starts once I have received the agreed access, materials, information and approvals needed to begin. The estimate may be extended where access is delayed, information is missing, the website or hosting environment causes unexpected issues, or you request changes outside the agreed scope. I will let you know if a material delay becomes apparent.

You are responsible for providing accurate information, lawful content, working access credentials and the permissions needed for me to work on the website. You must have authority to instruct changes to the website and to provide any materials you supply.

You should maintain a current backup of your website and hosting account before work begins. Where practical, I may also take reasonable precautions before making changes, but I cannot guarantee that a backup will be available or restorable in every hosting environment.

6. Review, approval and revisions

You will have a reasonable opportunity to review the completed work against the scope agreed before the project started. Please identify any specific issue or mismatch with that scope as clearly as possible.

Approval confirms that you have reviewed the delivered result and accept it as completion of the agreed scope. Approval does not waive rights that cannot legally be waived, including applicable statutory rights relating to non-conforming services.

Unless the written offer states otherwise, the fee covers the work described in the agreed scope, not unlimited revisions, new features, new pages, additional content or changes requested after approval. Any further work can be quoted separately.

7. Performance targets and third-party services

Where a specific Google PageSpeed Insights target or other measurable result is expressly included in the written offer, I will use reasonable professional efforts to achieve that target and will verify the result using the agreed testing method. A target applies only to the website, pages, device category, test conditions and scope identified in the offer.

Performance scores and website behaviour can vary due to factors outside my control, including hosting capacity, server response, plugins, themes, third-party scripts, advertising tags, analytics, fonts, external APIs, content changes, network conditions, testing tools and updates made by you or other providers. I cannot guarantee permanent scores or rankings, sales, leads, advertising costs, conversion rates or search engine positions unless a specific written guarantee expressly says otherwise.

CDN, hosting, caching, security, payment and other third-party services are subject to their providers' terms, availability, technical limits and pricing. I do not control those providers and cannot guarantee uninterrupted availability or that their free or paid plans will remain unchanged. Any ongoing subscription or third-party charge must be agreed separately and is not included unless the written offer expressly says so.

8. Your website, content and access

You retain ownership and responsibility for your website, domain, hosting account, business data and materials. You confirm that you have the rights and permissions needed for all text, images, fonts, videos, logos, plugins and other materials you ask me to use.

You are responsible for the accuracy and legality of your website content, privacy notices, cookie notices, terms, advertising claims, data collection practices and compliance with laws applicable to your business. Unless expressly agreed in writing, my services are technical and design services and do not include legal, tax, cybersecurity certification or regulatory advice.

Please use temporary or limited-access credentials where possible and revoke access that is no longer needed after the project.

9. Intellectual property

You retain rights to materials you provide. Once the agreed fee has been paid in full, I grant you the right to use the project-specific deliverables created for you as part of the service, for your website and business purposes, subject to any third-party licence terms.

Pre-existing tools, methods, code snippets, know-how, reusable components and materials that I own or have a right to use remain mine or their respective owners'. Open-source software, plugins, fonts, stock assets and other third-party materials remain subject to their own licences. I do not transfer ownership of third-party materials.

Until full payment is received, you must not resell, distribute, publish as a standalone product or commercially exploit project-specific deliverables beyond what is necessary to review and test the work. This does not affect rights that cannot legally be restricted.

10. Cancellation and the right of withdrawal

If you are a consumer or another person protected by mandatory consumer law, you may have a statutory right to withdraw from a distance contract within 14 days, subject to the applicable legal rules and exceptions. Nothing in these Terms removes a right that the law does not allow me to exclude.

If you ask me to begin the service before the 14-day withdrawal period has ended, I will ask you for your express request and confirmation before starting. Where the law permits the withdrawal right to be lost after full performance of a service, that loss applies only if you were informed in advance, expressly requested early performance and acknowledged that you would lose the right once the service was fully performed.

Early-start request and acknowledgement:

“I expressly request that work on my order begins before the 14-day withdrawal period expires. I acknowledge that once the service has been fully performed, I will lose my statutory right of withdrawal, where the law provides for this.”

I will ask you to send or otherwise provide this confirmation in a durable written form (such as email or WhatsApp) before work starts. A clause in these Terms alone, without your express prior confirmation, is not treated as your consent.

If you cancel after asking me to start but before the service is fully performed, any amount legally payable for the work already performed will be determined in accordance with applicable consumer law. Business customers' cancellation rights are determined by the agreed contract and applicable law.

11. Complaints and service issues

If you believe the service does not match the agreed scope, contact me at hi@michalkanclerz.com. Include your name, the website or project, the date of the order and a clear description of the issue. Screenshots or other evidence may help me investigate.

I will review the complaint and respond within 14 days where the statutory consumer complaint-response deadline applies. If mandatory law gives you a stronger or different remedy, that law takes priority. Depending on the issue and the applicable law, a remedy may include correction, completion, a price reduction or a refund. A complaint process does not remove statutory rights.

For business customers, I will assess a complaint against the agreed scope and the applicable contract and law. Please report issues promptly so that I can investigate while the relevant website state and technical records are available.

12. Liability

I will perform the agreed work with reasonable care and skill. To the extent permitted by law, I am not responsible for losses caused by inaccurate or incomplete information supplied by you, unauthorised changes made by you or another provider, third-party outages or changes, unsupported software, hosting restrictions, or use of the deliverables contrary to my instructions.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for intentional wrongdoing or mandatory consumer rights. For business customers, and only to the extent permitted by law, I am not liable for indirect or consequential loss, loss of profit, revenue, anticipated savings, business opportunity or data, except where such loss results from liability that cannot legally be excluded.

You remain responsible for maintaining appropriate backups and for reviewing your website, content, legal notices and business operations after delivery.

13. Privacy and communication

Personal data is handled as described in the Privacy Policy. Project communication may take place by email or WhatsApp. You agree to use the contact details you provide and to keep them accurate so that important project messages can reach you.

14. Applicable law and disputes

These Terms are governed by the laws of Poland, without prejudice to mandatory consumer protection rules that apply in your country of residence. If you are a consumer, you may bring proceedings before the courts that have jurisdiction under mandatory law. Nothing in these Terms deprives you of mandatory consumer protections.

If a dispute arises, please contact me first so we can try to resolve it directly. Consumers may also use the relevant consumer assistance and dispute-resolution bodies available under applicable law.

15. Changes to these Terms

I may update these Terms when the services or applicable law change. The version published on this page applies to new orders from its stated update date. The terms agreed for an existing order will not be changed retrospectively without your agreement, except where a change is required by law.
